How do I change my children's last name?

It used to be a standard edict that children kept the father’s name as long as he maintained his parental responsibilities.  This has changed somewhat, and the court now has the responsibility of deciding which name is in the child’s best interest.  The judge must consider factors such as whether there is a remarriage, whether the father’s name has been used for a long time, and the important of the bond between the father and the child.


If there is a remarriage in the picture, and the stepparent adopts the child, then the child’s name can legally be changed during that procedure. Adoption can of course only occur if the natural parent gives up (or loses) his parental rights.
