States that follow the Equitable Property Distribution rule do not necessarily aim for a 50/50 split of property. Each spouse can receive between one and two thirds of the property. The method the judge uses for determining the split is subjective. Considerations that impact the property split may include factors such as who purchased the property, income levels of each spouse, whether one parent stayed home with children, domestic abuse, drug abuse, infidelity, length of marriage, health of the spouses.
